GENERAL
I reserve the right to refuse a commission without reason or explanation.
Inappropriate/aggressive behavior of any kind will not be tolerated. Should this or a breach of the Terms of Service occur, I can stop or cancel the commission.
Poor communication may also be grounds for stopping the commission.
The client must read, understand, and agree to all the terms. By continuing with the commission and going forth with the payment, the client has agreed to the below terms.
Commissioned art is prohibited from being used to promote any hateful rhetoric.PAYMENTS
Prices are subject to change according to size, complexity, and/or detail of the piece at the discretion of the artist.
Full payment takes place immediately after the artist accepts the commission.
The commission must be paid in full before it is started, unless a payment plan is established.
A group commission must be paid for by 1 (one) person in order to avoid complications and miscommunications.
Final prices are non-negotiable.REVISIONS
Clients may request changes only if I have made a design mistake. Other revisions may be subject to additional fees.DEADLINES AND DELIVERY
If the commission is needed by a specific deadline that is communicated to me in advance, I might charge a rush fee.
Final commission pieces will be sent through email or the platform of the client’s choice in order to receive the full quality image.
Allow up to 2 months for commission turnaround.INTELLECTUAL PROPERTY RIGHTS AND USES
Client is not allowed to put finished commission through any artifical intelligence software.
The commissioned piece may not be used for commercial purposes and cannot be redistributed or reproduced, unless the client has clearly communited this intention prior to the start of the commission and has paid the commercial fee.
Streaming and reposting the piece (with artist credit) is allowed and not considered commercial use.
The client may not make any profit off of the piece, which includes but is not limited to selling prints, physical items, etc unless the client has clearly communited this intention prior to the start of the commission and has paid the commercial fee.
The artist retains all rights to the piece of artwork itself, but the client retains all rights to the character presented in the artwork.
The artist retains the right to crop, edit, or alter the image for promotional use.
The artist does not claim any rights to any intellectual property or the character(s).
The client may not alter or edit the piece of artwork itself unless agreed upon by the artist.
The art piece may be reposted to the clients social platforms of choice so long as credit is given to the artist.
The client may not claim the commissioned piece as drawn by them.
The commissioned artwork may not be resold.
The artist is not responsible for providing the client with a physical object, print, merchandise, etc. of the artwork, unless agreed upon in which a fee may be applied.
The client may print a copy of the commissioned artwork for personal use. It may not be redistributed or sold in any way.REFUNDS
If the client wishes for a refund before beginning any work, a full refund will be provided.
Refunds are provided on a case-by case basis and are generally not given if the commission has been started unless the artist is not able to finish the commissioned work by the deadline, in which case a full refund will be provided. Partial refunds may be provided depending on what stage of work the commission is in at sole discretion of the artist.COMMUNICATION
The client must provide clear and concise references/descriptions of their character(s) in order to avoid confusion.OTHER
By providing the client with a line of communication to the artist, the client agrees to act in a professional manner.
The client may not redistribute the artist’s contact (such as email or phone number) in any way unless agreed upon by the artist in advance.
Should any terms of service be breached, or the artist incurs damages caused by the client, the artist reserves the right to either issue a takedown DMCA notice or pursue damages through the Copyright Law of the United States (https://www.copyright.gov/title17/)ADOPTS/CUSTOM CHARACTERS
Adopts may be resold or traded as long as the price does not exceed the original sale price. The only exception to this is if the character in question has since gained more art of it, such as other commissioned work. Gift artwork does not add to the value of the chartacter.
All adopts are non-commercial unless discussed with the artist prior or a commercial fee is paid. The client may use the character for personal use and the artist must be credited as the creator of the design.
No refunds are provided for adopts. They are final sale.
All terms of service above continue to apply to the adopt.
Adopts may not be used for hate speech or harrassment.
Edits are allowed to the original adopt as long as the original artist is always credited for the original design.
By purchasing an adopt, the client is purchasing the right to own the design (NON-commercially). The artist retains all rights to the artwork itself. A separate commercial fee must be paid in order to utilize a design for monetary gain.A complete buy-out of a design can be negotiated with the artist for an additional fee. A buy-out will include all rights, commercial and personal, and the artists terms of service will no longer apply.
